1. Acceptance of Terms

By downloading, installing, or using the AeroSpot mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

AeroSpot is an aviation spotting application that allows users to track flights, log aircraft sightings, build collections, compete on leaderboards, and connect with other aviation enthusiasts. The App is available on iOS and Android platforms.

3. User Accounts

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate and complete information when creating your account
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

You must be at least 13 years old to create an account and use the App.

4. Subscription Plans

AeroSpot offers the following subscription tiers:

  • Free: Basic features with limited spotting entries
  • Pro ($4.99/month): Unlimited entries, AI identification, advanced features
  • Premium ($9.99/month): All features including export, priority support, ad-free experience

Subscriptions are billed through your Apple App Store or Google Play Store account. You can manage or cancel your subscription through your device's app store settings.

5. Advertising

The Free and Pro versions of AeroSpot display advertisements provided by Google AdMob. By using these versions of the App, you consent to the display of advertisements. Premium subscribers enjoy an ad-free experience. For information about how advertising data is collected and used, please refer to our Privacy Policy.

6. User Content

You retain ownership of any content you submit to the App, including photos and spotting data. By submitting content, you grant AeroSpot a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App and for promotional purposes.

You agree not to submit content that:

  • Infringes on intellectual property rights
  • Is illegal, harmful, or offensive
  • Contains malware or malicious code
  • Violates the privacy of others
  • Is false or misleading

7. AI Photo Verification & Anti-Cheat Policy

AeroSpot uses AI-powered photo verification to maintain the integrity of leaderboards and collections. By using the App, you agree that:

  • Photos submitted for spotting verification may be analyzed by our AI systems
  • Submitting fake, manipulated, or stock photos is prohibited
  • Attempting to manipulate leaderboards through fraudulent sightings will result in account suspension
  • We reserve the right to remove any content that fails verification or appears fraudulent
  • Repeated violations may result in permanent account termination

8. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Use automated systems or bots to access the App
  • Impersonate another person or entity
  • Manipulate leaderboards or achievements through fraudulent means
  • Harass, abuse, or harm other users

9. Third-Party Services

The App integrates with third-party services including FlightRadar24 for flight data and Google AdMob for advertising. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the content, privacy practices, or availability of third-party services.

10. Intellectual Property

The App, including its design, features, and content (excluding user content), is owned by AeroSpot and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. FLIGHT DATA IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON FOR FLIGHT PLANNING OR SAFETY DECISIONS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AEROSPOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease. You may also delete your account at any time through the App settings or by contacting us.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App. Your continued use of the App after such changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.
